If lights stay on in both positions then try pressing up on the clear portion of the lights, they each have an internal switch that will turn them on all the time ... You have to use the fob or hold your finger on the pixel indent on the handle on either the driver or passenger side door. Oddly, if you walk past the car without getting in, it will unlock when you get close, like normal, and then lock again when you walk away. I agree, it's something I don't like on the new Crosstrek.
